1. Parties and Scope

These Terms govern the relationship between Stormkey (responsible person: Mike Wicki, Stadtstrasse 15, CH-6204 Sempach, Switzerland) and users of the Stormkey service. The service includes the browser-based file encryption solution, browser extensions, APIs, and related websites.

2. Acceptance and Registration

Use of the service requires acceptance of these Terms. During signup, users must actively accept the Terms and Privacy Policy. Registration information must be accurate; minors require consent from a parent or legal guardian.

3. Service Scope and Plans

The Free plan is intended for personal entry-level use. Professional and Business are paid monthly plans where Stripe and plan enablement are active. Prices, limits, and functionality may change with reasonable notice.

4. Acceptable Use and Prohibited Content

Stormkey may be used only for lawful purposes. Users are solely responsible for ensuring that their files, links, messages, and other use are lawful and do not infringe third-party rights.

Prohibited uses include unlawful content or conduct, child sexual abuse material or any exploitation of minors, malware, phishing, fraud, identity abuse, extortion, doxxing, calls for hatred or violence, terrorism, infringement of copyright, trademarks, personality rights or confidentiality rights, unauthorized automated access, reverse engineering, credential sharing, and any activity that harms third parties or the service.

Stormkey is an encryption service and does not generally or actively monitor content. However, Stormkey may review reported links, accounts, metadata, and available technical information and, where violations are found or reasonably suspected, disable links, delete files, suspend or delete accounts, preserve evidence, and notify authorities or specialized reporting bodies where required or appropriate.

4a. Reporting Illegal Use

Reports of illegal content, abuse, or rights infringement can be submitted through the contact form or by email to contact@stormkey.app. A report should, where possible, include the affected Stormkey link or account email, a short description, the alleged legal violation, contact details, and relevant evidence.

Stormkey triages reports by risk and plausibility, documents the decision, and may take temporary or permanent action against links, files, or accounts where there is a substantiated concern. Obvious emergencies, suspected CSAM, malware, fraud, or extortion are prioritized. Where appropriate, Stormkey confirms receipt and informs reporting parties of the outcome without disclosing confidential data of other users.

5. No Recovery and User Responsibility

Stormkey follows a client-side encryption principle. Without the correct password and required context, a file generally cannot be recovered, not even by Stormkey. Users are solely responsible for password choice, storage, and separate transmission.

6. Payments and Termination

Paid subscriptions are billed monthly in advance through Stripe. Card data is not stored by Stormkey. Subscriptions may be cancelled effective at the end of the current billing period. Account deletion may end access immediately; no automatic refund is issued for the remaining period. Stormkey may suspend or delete accounts that violate these Terms.

7. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Stormkey excludes all liability. Stormkey is not liable for data loss caused by lost passwords, third-party outages, misuse, indirect damages, lost profits, or consequential damages. Any liability is capped, where legally permissible, at the amount paid by the user in the relevant month.

8. Availability and Changes

Stormkey aims for high availability but does not guarantee uninterrupted availability or any SLA unless separately agreed. Stormkey may update these Terms and the service; material changes will be notified to registered users.

9. Intellectual Property, Privacy, and Law

All rights in the platform, code, brand, and content remain with Stormkey. Personal data is processed according to the Privacy Policy. Swiss law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Jurisdiction for disputes with businesses is Zurich, Switzerland.
